UK Spouse Visa Processing Time 2026 How Long Does It Take

UK spouse visa application documents and processing time guide 2026 by ImmigrationLaw.org.uk

How Long Does a UK Spouse Visa Take in 2026?

Processing times for a UK spouse visa in 2026 depend on where you are applying from and which service you choose.

Out of country applications (applying from outside the UK) typically take between 12 and 24 weeks on the standard service. If you need a faster decision, the priority service usually returns a result within 30 working days for an additional £500 fee. Super-priority is not currently available for out of country spouse visa applications.

In country applications (applying from within the UK, also known as FLR M or leave to remain as a partner) typically take around 8 weeks on the standard service. Priority service returns a decision within 5 working days.

These are target processing times based on current Home Office service standards. Actual times fluctuate depending on application volumes, the complexity of your case, and whether the Home Office requests additional documents. Always check the official Home Office processing times page before submitting.

What Is the UK Spouse Visa?

The UK spouse visa allows the foreign national partner of a British citizen or settled person to live in the United Kingdom. It falls under Appendix FM of the Immigration Rules and covers spouses, civil partners, and unmarried partners who have been in a genuine relationship for at least two years.

If your application is successful, you will be granted an initial period of 33 months if applying from outside the UK, or 30 months if applying from within. After completing 60 months on this route you become eligible to apply for Indefinite Leave to Remain.

The Financial Requirement in 2026

The financial requirement is the most common reason UK spouse visa applications are refused. Since 11 April 2024 the sponsor must demonstrate a gross annual income of at least £29,000.

If the sponsor does not meet this threshold through employment income alone, specified savings can be used to make up the shortfall. The rules require a base of £16,000 in savings plus an additional amount equivalent to 2.5 times the difference between the sponsor's actual income and the £29,000 requirement.

Evidence of income must be provided in a specific format. Payslips, bank statements, and employer letters must all meet the exact requirements set out in Appendix FM-SE. Applications submitted with incorrect or incomplete financial evidence are routinely refused.

Relationship Requirements

The Home Office scrutinises the validity of every relationship. To qualify you must meet all of the following:

Age: Both the applicant and the sponsor must be aged 18 or over at the date of application.

Sponsor status: Your partner must be a British citizen in the UK, settled in the UK, or hold a qualifying status such as refugee leave or limited leave under Appendix EU.

Validity of the relationship: You must have met in person. The marriage or civil partnership must be legally valid. The relationship must be genuine and subsisting.

Previous relationships: Any previous relationship of the applicant or sponsor must have broken down permanently.

Future intentions: Both parties must intend to live together permanently in the UK.

English Language Requirement

Applicants must demonstrate they meet at least level A1 of the Common European Framework of Reference (CEFR) in speaking and listening. This is evidenced by a certificate from an approved English language test provider.

You may be exempt if you are aged 65 or over, have a physical or mental condition that prevents you from meeting the requirement, or if there are exceptional circumstances.

TB Screening

If you are applying from a country where tuberculosis screening is mandatory, you must undergo testing and provide a valid medical certificate confirming you are free from active pulmonary TB before your visa can be granted.

Accommodation Requirement

You must provide evidence that your family will have adequate accommodation in the UK without recourse to public funds. The accommodation must be owned or occupied exclusively by your family, must not be overcrowded, and must not contravene public health regulations.

How Long Will Your Spouse Visa Last?

An initial out of country application grants 33 months entry clearance. You can then apply for an extension which is granted for a further 30 months. After 60 months on this route you become eligible to apply for Indefinite Leave to Remain. Naturalisation as a British citizen typically follows 12 months after ILR.

Common Reasons UK Spouse Visa Applications Are Refused

The most frequent reasons for refusal are insufficient financial evidence, failure to demonstrate the relationship is genuine, incorrect or incomplete documentation, and failure to meet the English language requirement.

A refusal is not the end of the process but it creates a negative immigration history that affects future applications. If you are refused, you generally have the right to appeal to the First-tier Tribunal. Time limits apply so legal advice should be sought immediately.

Should You Use a Solicitor for Your Spouse Visa Application?

The spouse visa route is technical. The financial requirement alone involves complex evidential rules under Appendix FM-SE. Applications submitted without legal advice are refused at a significantly higher rate than those prepared by an SRA-regulated solicitor.

A solicitor will review your financial evidence, check your relationship documents, identify any potential issues before submission, and prepare a properly structured application that meets every requirement.

We match you with vetted, SRA-regulated immigration solicitors who handle spouse visa applications regularly. Free assessment. No obligation.
